A Win by McCain Could Push a Split Court to Right - This is true but the alternative is not.  If Obama wins, he will likely preserve the status quo by allowing liberals to retire and be replaced by younger liberals.  It's unlikely that any conservatives would retire were Obama to win. 

Conservatives warm to McCain on the Law - Friday Dick Morris argued on Hannity and Colmes that increased focus on the Supreme Court helps the Democrats.  The focus on the Court will help McCain by solidifying his conservative base.  I think the Supreme Court focus is a bigger benefit to McCain than it is to Obama.
